Freedom of religion between European human rights law and national law (Doctoral thesis)

In recent world history, the human rights doctrine has been primarily concerned with the protection of human dignity. Since states are the “makers and breakers” of international law, the need to determine human rights standards appears to be a constant battle between rhetoric and the effective implementation of human rights. In addition, when law and religion meet, a shared definition of the latter does not exist in the context of human rights conventions, and it is difficult to detect it in national legal orders. This research was organized around three axes: a) freedom of religion, as a standard either of hard law or soft law, but also as an interpretative concept in European and national case law, b) interaction between European human rights law and national law and more precisely constitutional law or, in other words, between the principles which derive from universality and those which derive from diversity or national particularity and c) the comparison as a methodology that is developing, on the one hand, between Turkey and France as two legal and constitutional systems whose core is secularism and the religious neutrality of the State and, on the other side, between these systems and the European level, i.e., mainly the Council of Europe and the European Union. In the framework of the theory of freedom of religion and between the evolution of the norm from the national level to the European level and from the European norm to the national norm, the research analyses the meta-principles of legal certainty, universality of freedom of religion, national diversity, and dynamic neutrality.
