Comparison of the legislative framework regarding the modification of the human genome with the crisp-cas 9 method between the USA and the European Union (Master thesis)

The scientific community has always been looking for ways to deal with the diseases that plague humanity, with the aim of treating them and the consequent lengthening, as well as improving the way of life. These efforts have received a huge boost, due to the extremely growing field of Genetic engineering.Thus, now scientists have made discoveries, which in previous years existed only in science fiction movies. One such discovery is the CRISPR-Cas 9 method, which can be used to edit the genomes of both humans, animals and plants, which provides infinite possibilities for scientists. At the same time, however, it also gives rise to responsibilities regarding the way it is used, especially when it is applied to humans. Many critical issues arise from the use of this method, as it is a particularly promising technology, but also highly controversial. From the research carried out for the preparation of this work, both regarding the legislative framework in the USA and the legislative framework in the EU, it was observed that there is no special legislative framework, which regulates the specific subject, but is regulated only indirectly.In addition, due to the lack of specific laws it has become clear that there is no uniform regulation, neither between the different US states, nor between the EU states, which creates a lot of confusion and different approaches. The ethical concerns are varied and the need for a special legislative framework is deemed imperative. The most ideal solution is the establishment of an international legislative framework, which will have legal binding force for all countries. The aim is to set a common demarcation on the development and use of such technologies, as the different legal frameworks show wide divergences and there is a risk of two-speed worlds emerging. Finally, bioethics committees must play a key role in the enactment of legislation, given that the issue is multidimensional and touches on the subject of different sciences.
