Στρατηγική περιβαλλοντική εκτίμηση – το Πρωτόκολλο του Κιέβου (Master thesis)

The issue of protecting and improving the environment has increasingly emerged in recent years as a primary factor of our quality of life. That is why it has internationally become a top priority of the states’ government policy in planning their national development.
During the last fifty years, when environmental concerns became progressively more intense around the world, transnational partnerships were attempted and multilateral international treaties were signed for the adoption of common institutional tools of preventive intervention in order to achieve the best possible results in effective environmental protection. Accordingly, regulations were introduced at both national and supranational level laying down procedural requirements for the lawful and permissible planning and implementation of development initiatives.
The Environmental Impact Assessment at project level and the Strategic Environmental Assessment at a higher decision-making level regarding a strategic plan, policy or program are the evolution of preventive policy for the protection of the environment as a prerequisite for the implementation of the development project.
This thesis is prepared in accordance to the rules and regulation regarding the completion of my postgraduate studies at the Postgraduate Program “International and European Energy Law” and focuses on the analysis of the Strategic Environmental Assessment and the Kiev Protocol, the provisions of which regulate the international obligation of the contracting states to prepare the Strategic Environmental Assessment before deciding on a policy, a plan or a program.
In particular, the historical context of the Kiev Protocol is mentioned in introduction, the meaning of the term Strategic Environmental Assessment is analyzed and it is attempted a comparison with the Environmental Impact Assessment. The basic principles underlying the process of preparing the Strategic Environmental Assessment are highlighted and further it is explained how the provision for health protection is linked environmental protection.
It then develops its implementation and its advantages from it, the stages of its conduct, the importance of public participation in it and its role in promoting sustainable development. The regulation of the Strategic Environmental Assessment is also examined in the context of European law with reference to relevant provisions for it in the Greek legal order.
