This thesis explores the critical role of international arbitration in resolving disputes within the energy sector, focusing on the liberalization of energy markets and the promotion of foreign investment. Through an analysis of historical, modern, and recent arbitration cases, the thesis examines how arbitral institutions like the International Chamber of Commerce (ICC) and the International Centre for Settlement of Investment Disputes (ICSID) have contributed to shaping global energy markets. The study also highlights the tension between state sovereignty, environmental policy, and investment protection, emphasizing the challenges that arise when states implement policy changes that affect foreign investments, particularly in the context of renewable energy and climate change. Recent arbitration cases, such as Vattenfall v. Germany and NextEra v. Spain, demonstrate the growing complexity of energy-related disputes and the need for a balanced legal framework that respects both investor rights and public policy goals. By analyzing these cases, the thesis underscores the evolving nature of arbitration in the energy sector and its vital role in fostering a stable investment environment amid regulatory and geopolitical changes.
