The public prosecutor is a judicial okicer and a representative of the prosecution authority, which is independent of the courts and has the mission of preserving public order, protecting citizens and upholding legality. The prosecutor's responsibilities mainly concern procedural actions or duties within the framework of criminal proceedings and criminal procedure in general (e.g. conducting a preliminary examination, conducting criminal prosecution, supervising police authorities, submitting proposals to criminal courts and councils, etc.). However, the Constitution and the laws of the State reserve for the public prosecutor an important position in the entire spectrum of civil law, especially in that of family law, placing him as a defender of the preservation of public morals and social order. The purpose of this paper is to clarify the role played by the public prosecutor in family law, through a thorough presentation of the rights granted to him by substantive law, as well as his procedural position in civil litigation. Consequently, in Part A of this paper, a general introduction is made to the position of the prosecutor, while in Part B, his responsibilities in family law are analyzed, with the presentation of the issues being made in accordance with the structure of the Civil Code. Finally, in Part C, the position of the public prosecutor in civil litigation as an exceptionally litigant is briefly presented.
