| heal.abstract | Αντικείμενο διερεύνησης συνιστά ο θεσμός της παραγραφής των εγκλημάτων ως λόγος εξάλειψης του αξιοποίνου και ως ανυπέρβλητο διωκτικό κώλυμα. Ο τίτλος της διπλωματικής εργασίας προδίδει την χρήση της διαλεκτικής μεθόδου. Η παραγραφή εξετάζεται ως αυτοτελής περίσταση χρόνου που διατρέχει το ποινικό φαινόμενο και κάθε επιμέρους στοιχείο που το συνθέτει. Η έννομη συνέπεια της καθιστά κυρίαρχο τον ουσιαστικό χαρακτήρα του θεσμού. Στο κύριο μέρος η προβληματική εκκινεί από την αντιμετώπιση των εγκλημάτων πολέμου και των εγκλημάτων κατά της ανθρωπότητας, ως μορφών προσβολής των εννόμων αγαθών η απαξία των οποίων αξιώνει την υιοθέτηση της αρχής του απαράγραπτου για την αντιμετώπιση τους. Στη συνέχεια η προβληματική εντοπίζεται στις διακρίσεις των εγκλημάτων και σε οριακές περιπτώσεις εγκληματικών μορφών που δοκιμάζουν την σχέση των άρθρων 14, 17, 111 και 112ΠΚ, περιπτώσεις που η αξιόποινη πράξη -διακριτή από το αποτέλεσμα της- επηρεάζει την αφετηριακό σημείο της παραγραφής. Υπό το πρίσμα του μικτού χαρακτήρα του θεσμού, η έρευνα διέρχεται αναγκαστικά και από την αλληλεπίδραση του με θεμελιώδεις διατάξεις του ΚΠΔ. Η πραγμάτωση του ουσιαστικού ποινικού δικαίου γίνεται μόνον στην ποινική δίκη ή μέσω αυτής, ώστε οι ουσιαστικοί κανόνες να συνιστούν το περιεχόμενο της μορφής του δικονομικού συστήματος. Για τον λόγο αυτό, υλικό της προβληματικής συνιστούν η διάκριση των δικαστικών αποφάσεων, το απώτατο χρονικό σημείο ελέγχου της παραγραφής στην αναιρετική δίκη αλλά και η σχέση της παραγραφής με την λειτουργία του δεδικασμένου. Αυτή την προσέγγιση επιτάσσει η αλληλεπίδραση του ουσιαστικού ποινικού δικαίου με τους ποινικούς δικονομικούς κανόνες και η συνάρθρωση τους σε ενιαίο σύστημα που και αυτό κινείται στο χρόνο. Η παραγραφή των εγκλημάτων αποτελεί αναγνώριση ότι η αξιόποινη πράξη στην ιστορικότητα της μπορεί να καταστήσει αλυσιτελή την κινητοποίηση του συστήματος για την αντιμετώπιση της όταν ο χρόνος ως αυτοτελής περίσταση, έχει ήδη εκπληρώσει τον ανατεθειμένο στο σύστημα σκοπό. | el |
| heal.abstract | The thesis investigates the statute of limitations as a legal process that extinguishes criminal liability and operates as a procedural bar to prosecution. Employing the dialectical method, the analysis treats limitation as an autonomous temporal factor that permeates the criminal phenomenon and its constituent elements. Its legal effect affirms the substantive nature of the process. The core inquiry begins with war crimes and crimes against humanity, offences whose nature demands the adoption of the principle of imprescriptibility. The thesis then turns to the classification of offences and borderline cases of them that challenge the interplay of articles 14, 17, 111 and 112 of the Greek Penal Code, particularly where the punishable act -distinct from its result- influences the commencement of the limitation period. Given the hybrid nature of the statute of limitations, the research necessarily engages with key provisions of the Greek Code of Criminal Procedure. Criminal law is realized only through criminal procedure, making procedural norms the structural framework of its application. Accordingly, the analysis includes the typology of judicial decisions, the final point at which limitation may be assessed in cassation, and its correlation with the principle of res judicata. This approach reflects the systematic integration of substantive and procedural law within a temporal framework. The statute of limitations is anchored in the historicity of the criminal act that may render the activation of the legal system futile if time, as an independent circumstance, has already fulfilled the function assigned to the system of criminal procedure. | en |
